Terms of Use

01Scope

1.1SBP is business software that we operate for our own business. The app may only be used with an account issued by us. You use the app as an authorised user, for example as an employee or other person working for us.

1.2Your employment or service agreement with us and the Privacy Policy also apply. If your employment or service agreement and these terms conflict, your employment or service agreement prevails.

1.3These terms are directed at businesses (§ 14 BGB). The app is not offered to consumers.

02Account and access

2.1Your account is created, managed and closed by us. You need the address of the SBP portal and your sign-in details.

2.2Keep your password confidential and do not share your account. Tell your administrator or us immediately if you suspect misuse.

2.3We may suspend access temporarily if there are concrete indications of misuse or a security risk. We will inform you.

03Permitted use

You may use the app only for our business purposes and in accordance with applicable law. In particular, you must not:

• enter content that is unlawful or infringes the rights of others,
• record personal data, photos or signatures of other people without a legal basis, or without the information we require you to give,
• attempt to access data or functions you are not authorised for, or to bypass security measures,
• disrupt the service, overload it with automated requests, or reverse engineer the app beyond what the law allows (§ 69e UrhG),
• use the app to build a competing product.

04Content

4.1The content you and your colleagues enter or upload is business content, including CRM records, assignments, reports, time entries, photos, files and signatures. We are responsible for it.

4.2We process business content only to provide the service and as described in the Privacy Policy.

4.3Signed reports: once a report is signed and locked, it can no longer be changed in the app. Check a report's content before it is signed.

05Availability, offline use and updates

5.1The app needs a connection to the SBP portal for most functions. We do not guarantee uninterrupted availability. Some information, such as a running timer, is kept on the device and is sent only when you book or save it.

5.2Data that has not been saved or synchronised is lost if the app is deleted or the device is lost.

5.3We develop the app further and publish updates through the App Store. Some functions may require the latest version. If the server requires a newer app version, the app will ask you to update.

06Intellectual property

The app, the SBP software and their documentation are protected by copyright and are owned by us or our licensors. The licence to use the app is set out in the End User License Agreement.

07Liability

7.1We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and where we have given a guarantee.

7.2For slight negligence, we are liable only for breach of an obligation that is essential to proper performance and that the user may regularly rely on (cardinal obligation). Our liability is then limited to the typical, foreseeable damage.

7.3Otherwise, our liability is excluded.

08End of use

Your right to use the app ends when we close your account or your employment or service relationship with us ends. Uninstalling the app removes the data stored on the device (see the Privacy Policy).

09Changes to these terms

We may change these terms for valid reasons, such as new functions or changes in the law. We will publish the new version at https://microsites.snc-it.com/sbp/terms-of-service.html and in the app. Material changes are announced to users in advance.

10Final provisions

10.1German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

10.2The place of jurisdiction for merchants, legal entities under public law and special funds under public law is Hagenburg.

10.3If any provision is invalid, the remaining provisions stay effective.
